1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of our website located at turpincemeteryinc.org and all associated pages, content, features, and services (collectively, the "Site").

We reserve the right to terminate or restrict your access to the Site, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, images, photographs, audio clips, video clips, data compilations, software, design elements, and the selection and arrangement thereof — are owned by Turpin Cemetery Inc, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Turpin Cemetery Inc name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Turpin Cemetery Inc. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

You may view, download, and print pages from the Site for your personal, non-commercial use only, provided you do not modify the materials and you retain all copyright and other proprietary notices. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent, except as follows:

Your computer may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your web browser for display enhancement purposes.

4. Donations

When you make a donation through our Site, you are making a voluntary charitable contribution to Turpin Cemetery Inc, a registered 501(c)(3) tax-exempt organization. Donations are not purchases of goods or services and are generally tax-deductible to the fullest extent permitted by law. No goods or services are provided in exchange for your donation unless explicitly stated at the time of contribution.

All donations are processed through secure third-party payment processors. By making a donation, you represent that you are authorized to use the payment method provided and that the information you supply is true and correct. Donations are subject to our Refund & Donation Policy.

We reserve the right to refuse or return any donation at our discretion, including but not limited to donations that appear to be made under false pretenses, exceed reasonable amounts without verification, or are received from prohibited sources. Designated gifts will be used for the stated purpose to the greatest extent possible; however, if a designated fund is overfunded or cannot be used as intended, we reserve the right to redirect funds to a similar program in accordance with standard nonprofit practice and IRS guidelines.

5. Disclaimer of Warranties

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TURPIN CEMETERY INC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Turpin Cemetery Inc does not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site or the server that makes it available are free of viruses or other harmful components; or that the results obtained from the use of the Site will be accurate or reliable.

Information on the Site regarding burial records, plot availability, restoration timelines, volunteer schedules, and fundraising goals is provided for general informational purposes and may be updated without notice. You should contact us directly to confirm any information before relying on it for important decisions.

Any material downloaded or otherwise obtained through the use of the Site is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TURPIN CEMETERY INC, ITS BOARD OF DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Site.
Any conduct or content of any third party on the Site.
Any content obtained from the Site.
Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

7. Indemnification

You agree to defend, indemnify, and hold harmless Turpin Cemetery Inc, its board of directors, officers, employees, volunteers, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, your violation of any rights of a third party, or any content you submit or transmit through the Site.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

8. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than Kentucky.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Estill County or the Eastern District of Kentucky, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at info@turpincemeteryinc.org and attempt to resolve the dispute informally for a period of at least thirty (30) days. Most concerns can be resolved quickly and satisfactorily through direct communication.

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

The arbitration shall take place in Irvine, Kentucky, or at another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Turpin Cemetery Inc.

10. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect by posting a notice on the Site and updating the "Last Updated" date at the top of this page. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Site. We encourage you to review these Terms periodically for changes.

We may also, in the future, offer new services or features through the Site. Such new services and features shall be subject to these Terms unless otherwise stated when introduced.
